IoT Environment and Personal Information Protection Law in Korea

    Abstract

    The IoT environment is becoming real, however there is a risk of infringement of personal information on the opposite side of convenience and efficiency of IoT. Because it is essential to provide personal information in order to use the service or product, and the method for securing it is also limited due to the nature of the IoT. The legal debate on the IoT environment in which these benefits and risks coexist is still limited. Particularly, there are few academic discussions on various aspects to balance the protection and utilization of personal information. Therefore, this study suggests the improvement of the law and policy of Korea in order to spread the IoT environment. To do this, this study reviews related laws of the EU, the United States and Japan, and analyze legal issues related to personal information protection in Korea. This study is meaningful to explore the reasonable ways to strengthen the protection without interrupting the utilization of personal information in the IoT environment.
